Terms of Use

1. The service

DRChat automates clinics' customer service on Instagram: an AI agent in the Direct, comment automations, a team inbox, content publishing and account metrics.

2. Account and eligibility

• The platform is intended for businesses and professionals with an Instagram professional account they are authorized to manage.
• You are responsible for keeping your credentials confidential and for all activity in your account.
• The clinic's account owner decides which team members have access and with which role.

3. Clinic responsibilities

• Comply with Meta's Platform Terms, Instagram's Community Guidelines and applicable law, including the LGPD, as the controller of its contacts' data.
• Comply with the advertising and ethics rules of its field, such as the Brazilian Federal Council of Medicine's rules on medical advertising.
• Review the settings, texts and instructions of the AI agent and automations before enabling them.
• Ensure it has the right to use all content it publishes through the platform.

4. Artificial intelligence agent

The agent generates automatic replies and may make mistakes. It does not provide diagnoses and does not replace a health professional's assessment. The clinic can take over any conversation at any time, and the agent hands off to the team in the configured situations.

5. Prohibited uses

• Sending spam or unsolicited bulk messages.
• Collecting people's data without a legal basis or against Meta's rules.
• Publishing illegal, misleading or offensive content, or content that infringes third-party rights.
• Trying to access other clinics' data, bypass technical limits or harm the platform.

6. Dependence on Meta services

The service depends on Instagram's APIs. Changes, limits or outages on Meta's side may affect platform features without constituting a breach of these terms.

7. Pricing and payment

Plans, prices and payment terms are defined in the commercial proposal or the plan subscribed by the clinic.

8. Intellectual property

The platform, its brand and its code belong to Thynkr AI. The clinic's data and content remain the clinic's.

9. Suspension and cancellation

The clinic may cancel at any time. We may suspend accounts that violate these terms or Meta's rules. After cancellation, the clinic's data is deleted within 30 days, as described in the Privacy Policy.

10. Limitation of liability

To the maximum extent permitted by law, Thynkr AI is not liable for indirect damages, lost profits or failures caused by third-party services, including Meta and AI providers.

11. Changes

We may update these terms. Relevant changes are communicated to clinics with reasonable notice.

12. Governing law

These terms are governed by the laws of the Federative Republic of Brazil.
